Terms and Conditions for Participation in AFBW Events

  1. Organizer
    The Alliance for Fiber-Based Materials Baden-Württemberg e.V., Türlenstraße 6, 70191 Stuttgart (hereinafter "AFBW"/ Organizer), conducts in-person and online events (hereinafter "event/s").
  2. Scope
    These terms and conditions apply to all AFBW events and govern the rights and obligations in connection with a participant's attendance. They apply to both consumers and entrepreneurs, unless a clause specifies otherwise.
  3. Registration
    3.1 Registrations are binding.
    3.2 Registrations are generally considered in the order they are received. Registration can be done online, by email, in writing, or by fax.
    3.3 A contract is formed through registration and the receipt of the registration confirmation from the organizer. The registration confirmation is sent in writing, by email, or fax to the participant's provided address. The presentation of an event on the AFBW website or by any other medium, such as in a newsletter, does not constitute a legally binding offer.
    3.4 In online registrations, clicking the "Submit" button constitutes a binding registration for the event as presented on the offer page. Confirmation of registration receipt is sent via automated email immediately after submitting the order.
    3.5 By registering, the participant accepts these terms and conditions. Conditions and reservations made at the time of registration are not permissible and are considered not made. If a registration cannot be considered, this will be communicated immediately.
    3.6 To participate in an online event, technical requirements must be met, and there is a duty of cooperation from the participant, such as having an Internet connection and a suitable device. If these requirements are not met or if technical issues arise on the participant's side during the event, this does not constitute a reason for exemption from the payment obligation. For online events that are free of charge, AFBW may deny access if technical capacities are exceeded. The participant agrees not to share the confidentially received access data with third parties. If there is suspicion of misuse of the data by third parties, the participant is obligated to inform AFBW immediately.
    3.7 The organizer is entitled to make photo and sound recordings during the event and any accompanying programs (e.g., evening events, tours, networking, etc.) for documentation, marketing purposes, promotion of future events, etc. Recordings may also be provided to third parties (e.g., press) and used in media (website, social media), with AFBW respecting the personal rights of the participant.
    3.8 If you have registered for a fee-based event, you will receive an invoice for the participation fee. The invoice must be paid no later than 14 days after receipt. We reserve the right to cancel the event up to three days before its start. In this case, if payment has already been made, the full participation fee will be refunded.
    3.9 Individuals who have not fulfilled their financial obligations from previous events may be excluded from participation.
  4. Payment Terms
    4.1 If you have registered for a fee-based event, you will receive an invoice for the participation fee. The invoice must be paid no later than 14 days after receipt, with the full invoice number provided. We reserve the right to cancel the event up to three days before its start. In this case, if payment has already been made, the full participation fee will be refunded.
    4.2 The stated participation fees are generally gross amounts in Euros, as AFBW does not disclose VAT. AFBW is a professional association and not commercially active within the meaning of §2 of the VAT Act (UStG). Therefore, AFBW is not subject to VAT liability. A corresponding certificate from the tax office is available.
  5. Withdrawal by the Participant
    5.1 In addition to the cancellation right specified below, consumers have a right of withdrawal (see No. 6).
    5.2 The participant can withdraw from the contract without charge up to 14 days before the start of in-person events (3 days before the start of digital events).
    5.3 If a withdrawal is made after this deadline until 7 days before the start of in-person events, the organizer is entitled to charge 50% of the participation fee as a flat rate, and up to the third business day before, 80%. If a withdrawal is made on the day before or on the day of the event for both digital and in-person events, the flat rate is 100% of the participation fee. The flat rate is waived if a substitute participant is named. The participant is free to prove that no or significantly less damage was incurred to the organizer.
    5.4 Withdrawal must be made in writing. The decisive factor for maintaining the deadline is the receipt of the withdrawal statement at AFBW.
    5.5 If the participant registers within the last 14 days before the start of the event, withdrawal is not possible without cost. No. 5.3 applies.
  6. Right of Withdrawal for Consumers
    If you are a consumer within the meaning of § 13 BGB, you have a right of withdrawal in addition to the cancellation policy in No. 5.
    6.1 Right of Withdrawal You may revoke your contractual declaration within 14 days without stating reasons in text form (e.g., letter, fax, email). The deadline begins after receipt of this instruction in text form, but not before the conclusion of the contract and not before our obligations have been fulfilled according to Article 246 § 2 in conjunction with § 1 para. 1 and 2 EGBGB as well as our obligations according to § 312 e para. 1 sentence 1 BGB in conjunction with Art. 246 § 3 EGBGB. Timely dispatch of the revocation is sufficient to meet the revocation deadline. The revocation should be sent to:

    6.2 Special Notes Your right of withdrawal expires prematurely if the contract is completely fulfilled by both parties at your explicit request before you have exercised your right of withdrawal. (End of withdrawal instruction)
  7. Termination
    The participant may terminate participation in events no later than 14 days before the first day of the event. Otherwise, the participant can only terminate for important reasons. Termination must be declared in writing. The timeliness of the declaration is based on its receipt at AFBW.
  8. Cancellation and Modification of Events by the Organizer
    8.1 In the event of cancellation of the event for organizational reasons or due to force majeure, the participation fee already paid will be refunded. The organizer assumes no liability for expenses (e.g., flight and hotel costs) as purely financial loss, unless intentional or gross negligence on the part of the organizer caused the cancellation or the timing of the cancellation.
    8.2 Minor changes to the event program as well as speaker changes for important reasons are reserved by AFBW.
  9. Termination by AFBW
    AFBW may terminate the contract for important reasons, e.g., if the participant persistently disrupts the event or fails to make timely payment despite reminders. There is no claim for a refund of fees already paid.
  10. Liability
    10.1 The organizer is only liable for damages resulting from an intentional or grossly negligent breach of duty by the organizer, its legal representatives, or vicarious agents. This does not affect liability for injury to life, body, and health, for breach of essential contractual obligations, and under the Product Liability Act. Essential contractual obligations are those whose fulfillment is necessary to achieve the goal of the contract and on whose compliance the participant can regularly rely. In the event of a breach of essential contractual obligations, liability for damages is limited to the typically foreseeable damage, unless it was caused intentionally or through gross negligence, except in cases of liability for injury to life, body, or health.
    10.2 These terms and conditions apply exclusively. General terms and conditions of the participant apply only to the extent that AFBW has expressly agreed to them in writing.
  11. Data Protection
    11.1 AFBW is entitled to store and process all data of the participant necessary for the correct execution of the event, as long as it is directly or indirectly required for the implementation.
    11.2 We would like to inform you that you have the right to information (Article 15 GDPR), correction (Article 16 GDPR), deletion (Article 17 GDPR), restriction (Article 18 GDPR), data portability (Article 20 GDPR), and objection (Article 21 GDPR) regarding your personal data at any time.
    11.3 For online events, Zoom is used. This is a tool of Zoom Video Communications Inc. from the USA. In the course of using Zoom, personal data is processed. When using the Zoom website and downloading the software, the provider is responsible for data processing. However, Zoom can also be used via the Zoom app or through a browser version. In this case, data provided before or during participation is processed, such as first name, last name, participant IP addresses, and hardware information. Optionally, further information and recordings (video, audio, presentation, chat, survey function) may be stored. By registering, the participant agrees to this.
  12. Copyright
    12.1 AFBW may use contributions submitted during the event after approval by the speaker and, for example, publish them on the website or in an event volume.
    12.2 The use of scripts, books, software, and other teaching materials provided by AFBW is permitted only to the participant. Duplication and/or use by third parties are not allowed according to § 53 UrhG. The participant is also not authorized to rent, lease, or lend these materials.
  13. Jurisdiction
    13.1 The mutual rights and obligations arising from the contractual relationship are subject to the law of the Federal Republic of Germany.
    13.2 The place of jurisdiction is Stuttgart, Germany.
  14. Severability Clause
    In the event of the invalidity of individual provisions of these terms and conditions, the validity of the remaining provisions remains unaffected.
